Kevin Johnson research referred in a recent article about Justice’s use of the term illegal ‘alien’, featured in San Francisco Chronicle. The Supreme Court’s Feb. 27 ruling in Jennings vs. Rodriguez appears to be about creatures from outer space. Justice Samuel Alito was simply quoting federal law, which defines “aliens” as those who are not U.S. nationals.
Kevin says “The concept ‘alien’ brings all the images to mind — it’s not human, and it’s not us.” His 1997 essay in the University of Miami Inter-American Law Review gave further definition to the term: “Persons have rights while aliens do not.”
